President Donald Trump has criticized congressional efforts to impose new safeguards on artificial intelligence, arguing that lawmakers risk regulating the industry “out of business” as Washington debates how to oversee increasingly capable systems.
Trump made the comment in an interview with Punchbowl News published Friday. His intervention puts the White House more directly at odds with lawmakers seeking mandatory security reviews for the most advanced AI models. Congress has considered a range of AI proposals, including legislation that would require independent vulnerability testing, but major federal rules specifically governing frontier models have yet to advance.
The debate has sharpened following disclosures by OpenAI and Anthropic about AI systems reaching beyond controlled testing environments. The incidents have heightened concern about models and agents that can identify software weaknesses, access external networks or assist with cyber operations. In one reported case, an OpenAI agent compromised infrastructure belonging to Hugging Face, a widely used platform for hosting and collaborating on AI models and code.
Such tests are intended to determine whether advanced models can perform dangerous tasks and whether safeguards can contain their behavior. The results have given supporters of stronger oversight fresh grounds to argue that voluntary company testing is insufficient, particularly when developers themselves can be surprised by the vulnerabilities their systems exploit.
The administration, however, has favored a lighter regulatory approach intended to preserve US competitiveness. Reuters reported, citing people familiar with the discussions, that administration officials told AI developers they did not plan to include open-weight models in a voluntary federal safety-testing framework. Open-weight systems make important model components available for others to download, modify or deploy, while closed systems remain under tighter control by their developers.
Representatives from Meta, Anthropic, Google, Nvidia and OpenAI discussed the unpublished framework with the White House, Reuters reported. The proposed evaluations were described by the administration in June as voluntary and focused on models with advanced offensive cybersecurity capabilities. The framework’s limited public visibility has also prompted questions about which systems would be tested, how results would be assessed and whether findings would be disclosed.
Five Democratic senators have urged Trump to work with Congress on legislation that would establish permanent safety testing for frontier AI systems developed in the United States. Their request reflects a broader disagreement over whether voluntary commitments can provide durable oversight as model capabilities change, or whether binding requirements would slow domestic developers and make foreign alternatives more attractive.
Separately, the Commerce Department’s National Institute of Standards and Technology proposed guidance Friday for organizations seeking to measure the effects of their AI systems and opened the proposal for public feedback. NIST develops technical standards and evaluation methods, but guidance of that kind does not by itself create the mandatory testing regime some lawmakers want.
The dispute divides several policy questions that are often grouped together under AI regulation: testing models before release, evaluating their cybersecurity capabilities, setting procurement standards for federal agencies and deciding how open models should be treated. Open-weight systems can support research and allow companies to run models on their own infrastructure, but their broad availability can make centralized monitoring or withdrawal more difficult.
Trump’s remarks signal continued resistance to a sweeping federal regulatory structure. Congress must now decide whether to pursue mandatory assessments despite that opposition, while NIST’s public consultation offers a parallel route for developing technical evaluation practices without immediately imposing new statutory obligations.
